Introduction

Welcome to Pakistan Tournament. These Terms and Conditions ("Terms", "Agreement") constitute a legally binding contract between you (the "User", "Player") and Pakistan Tournament (SMC-PRIVATE) LIMITED (the "Company", "We", "Us", or "Our").

By registering an account, downloading the app, or participating in any tournament, you explicitly agree to be bound by these Terms. If you do not agree, you must immediately cease the use of our services.

1. Eligibility & Parental Consent

• 1.1. Age Requirement: While there is no strict age restriction to use the App, if you are under the age of eighteen (18), you explicitly declare that you possess the legal consent of your parent or legal guardian to register, participate, and pay entry fees.
• 1.2. Guardian Liability: The parent or legal guardian accepts full financial and legal responsibility for the minor's actions on the App. The Company shall not be held liable for unauthorized transactions made by minors.

2. Account Registration & Security

• 2.1. Data Collection: To provide our services, we require your Name, Phone Number, Email, in-game Usernames, Game IDs, and Payment/Banking details. For details on how we protect your data, visit our Privacy Policy.
• 2.2. Account Security: You are solely responsible for maintaining the confidentiality of your account credentials. The Company is not liable for any loss of funds or unauthorized access due to your negligence.
• 2.3. One Account Policy: A user is allowed to operate only one single account. Creating multiple accounts or using fake identities is strictly prohibited and will result in a permanent ban.

3. Entry Fees, Prize Pools & Virtual Wallet

• 3.1. Entry Fees: Participation in certain tournaments requires a non-refundable entry fee. Once an entry fee is deducted, it cannot be refunded, reversed, or canceled under any circumstances.
• 3.2. Not a Banking Institution: The in-app wallet or balance does not constitute a real-world bank account. The Company is not a financial institution, and your balance does not accrue interest.
• 3.3. Payouts & KYC: To withdraw winnings, the name on your Pakistan Tournament account MUST exactly match the name on your withdrawal method (Bank Account, JazzCash, EasyPaisa, etc.). We reserve the right to demand Identity Verification (CNIC/B-Form) prior to releasing substantial prize pools to comply with Pakistan's Anti-Money Laundering (AML) regulations.
• 3.4. Taxes: The User is completely and solely responsible for declaring their winnings and paying any applicable taxes to the Federal Board of Revenue (FBR) or local authorities. The Company shall not be held responsible for the User's tax liabilities.

4. Fair Play & Zero-Tolerance Policy

• 4.1. Prohibited Activities: The use of cheats, hacks, aimbots, third-party modification software, exploiting in-game bugs, teaming up in solo matches, or any form of unfair advantage is strictly prohibited.
• 4.2. Abuse and Toxicity: Abusive language, harassment, hate speech, or threats against other players or Company admins will not be tolerated.
• 4.3. Penalties: If a User is found guilty of any prohibited activity, the Company reserves the absolute right to:
  • Instantly and permanently ban the User's account.
  • Forfeit and confiscate any pending prize money or wallet balance without any refund.
  • Ban the User's device ID from future registrations.
  The Company's decision in such matters is final, binding, and cannot be challenged in any court.

5. Intellectual Property & Media Rights

• 5.1. Promotional Rights: By using the App and participating in tournaments, you grant Pakistan Tournament (SMC-PRIVATE) LIMITED a perpetual, worldwide, royalty-free license to use your Name, Username, Game ID, Team/Company Logos, Profile Pictures, and any gameplay footage, images, or audio (especially in the event of a victory) for marketing, advertising, social media promotions, and commercial purposes.
• 5.2. Non-Affiliation Disclaimer: "Pakistan Tournament" is an independent esports platform. We are NOT affiliated, associated, authorized, endorsed by, or in any way officially connected with PUBG, Tencent, Krafton, FreeFire, Garena, Apple Inc., Google LLC, or any of their subsidiaries. All game titles, trademarks, and registered brands are the property of their respective owners.

6. Disclaimers & Force Majeure

• 6.1. Internet & Power Issues: The Company is not responsible for any match losses, disqualifications, or poor performance resulting from your internet disconnections, high ping, lag, device failure, or local power outages (load-shedding) in Pakistan.
• 6.2. Server & Third-Party Issues: We are not liable if the official game servers (e.g., PUBG/FreeFire servers) crash, undergo maintenance, or face downtime during a scheduled tournament.
• 6.3. Government Actions: In the event that the Pakistan Telecommunication Authority (PTA), or any government body, bans or restricts access to certain games, internet services, or our App, the Company shall not be held liable for any unplayed tournaments or delayed payouts.

7. Limitation of Liability & Indemnification

• 7.1. Assumption of Risk: You participate in the tournaments at your own risk. The App and services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties.
• 7.2. Maximum Liability: To the fullest extent permitted by the law of Pakistan, Pakistan Tournament (SMC-PRIVATE) LIMITED, its directors, employees, and developers shall NOT be liable for any direct, indirect, incidental, financial, emotional, or consequential damages resulting from your use of the App.
• 7.3. Waiver of Claims: You hereby explicitly waive your right to initiate any class-action lawsuits, legal claims, or compensation demands against the Company for minor technical errors, account bans, or match outcome disputes.

8. Modifications to Terms

The Company reserves the right to update, modify, or replace these Terms at any time without prior individual notice. It is your responsibility to check this page periodically for changes. Continued use of the App constitutes acceptance of those changes.

9. Governing Law & Dispute Resolution

• 9.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.
• 9.2. Jurisdiction: Any dispute, controversy, or claim arising out of or relating to this Agreement shall first be attempted to be resolved amicably through mutual discussion. If unresolved, it shall be subject to the exclusive jurisdiction of the competent courts located in Faisalabad, Pakistan.
